1. Who we are

This Service is provided by VIBSL, a registered fictitious name of a Texas limited liability company ("VIBSL", "we", "us"), with its registered office at [REPLACE: business address]. The parent entity name is available on request to legal@vibsl.com . References to "you" mean the individual or entity that has accepted these Terms by signing in to the Service.

2. Acceptance

By signing in to or otherwise using the VIBSL platform (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. If you accept these Terms on behalf of an organisation, you represent that you have authority to do so.

3. The Service (beta)

VIBSL is currently a beta deploy platform. The Service:

  • Runs your container or static-site builds against frameworks and language runtimes the build worker recognises.
  • Deploys those builds either to VIBSL's multi-cloud backend cluster (currently Azure-backed) or, where available, into your own cloud subscription (Bring-Your-Own-Cloud — Azure is GA; AWS and GCP are in beta).
  • Runs the per-build security checks described on our security page.

Features described in marketing material as roadmap, coming soon, or in beta are not part of the Service today. Do not rely on them for production decisions until they appear in this section as shipping.

4. Your responsibilities

You agree to:

  • Provide accurate registration information.
  • Keep your account credentials confidential and not share them.
  • Use the Service in compliance with applicable laws, including export controls and data protection.
  • Not deploy code or content that is unlawful, infringing, malicious, or in breach of a third party's rights.
  • Not attempt to probe, disrupt, or reverse-engineer the Service except as permitted by law.

5. Beta plan, billing & cancellation

The Service is currently free of charge for beta participants. When we move to GA, the prices on our pricing page will apply. We will notify you by email at least 30 days before any charges begin.

You can cancel and stop using the Service at any time by deleting your account from the dashboard or emailing support@vibsl.com . Beta access does not auto-convert into a paid plan — we will ask you to opt in.

6. Service availability — no SLA in beta

During beta we do not offer an uptime SLA, support response-time SLA, or service credits. Enterprise customers may sign a separate written SLA at GA.

7. Your content

You retain all rights in the source code, container images, configuration, environment variables, and other content you deploy through the Service ("Your Content"). You grant us a limited licence to clone, build, scan, store the build artifacts (image, SBOM, scan results, logs), and run Your Content on the cluster you selected solely to provide the Service. We do not claim ownership over Your Content and we do not use it to train shared models.

8. Intellectual property

The Service, the VIBSL name, logo, and the underlying software, documentation, and brand assets are owned by VIBSL or its licensors and are protected by copyright, trademark, and other intellectual-property laws. These Terms do not transfer any of those rights to you.

9. Third-party services

The Service depends on third-party providers (including, today, Microsoft Azure, GitHub, Cloudflare, and the framework / language ecosystems whose tooling we invoke). Your use of the Service is also subject to those providers' terms where they apply to your deployment. A current sub-processor list is available at our privacy policy.

10. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. Beta features may break, change, or be removed at any time.

11. Limitation of liability

To the maximum extent permitted by law, VIBSL will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) amounts paid by you to VIBSL in the 12 months preceding the claim, or (b) US $100.

12. Indemnification

You agree to defend and indemnify VIBSL against any third-party claim, damage, loss, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service in breach of these Terms or applicable law, or (c) your violation of any third-party right through your use of the Service.

13. Termination by either party

You may stop using and delete your account at any time. We may suspend or terminate your access where (a) you materially breach these Terms, (b) we are required to by law, or (c) we discontinue the Service (we will give 30 days' notice for an orderly discontinuation unless prevented by law). On termination, your right to use the Service ends and we will delete or return Your Content within a reasonable period, subject to legal retention obligations.

14. Copyright complaints (DMCA)

If you believe content deployed through the Service infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to legal@vibsl.com . We will respond in accordance with our designated-agent obligations under the DMCA.

15. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and each party consents to that jurisdiction. Either party may seek injunctive relief in any competent court for intellectual-property infringement or unauthorised use.

16. Export controls

You acknowledge that the Service may be subject to US export control laws (including the EAR) and other applicable export regulations. You will not use, export, or re-export the Service in violation of those laws.

17. Changes to these Terms

We may modify these Terms. If we make a material change we will notify you at the email address on your account at least 30 days before the change takes effect (or sooner if the change is required by law). Your continued use of the Service after the change takes effect means you accept the updated Terms.
